"CLIENT" means You. 
The person who accepts a quote or offer given by the Provider for the sale of Services or whose order for the Services is accepted by the Provider; 

"PROVIDER" means Us.

"The Contract"

Means the contract for the provision of ground transfer services under these Conditions;

"SERVICE"

Means the service of ground transport (including any instalment of the service or any multiple services) which the Provider is to supply in accordance with these Conditions.

Bookings must be made at least 48 hours before the required pick-up time. You can change, amend or cancel your booking at any time up to twenty-four hours before the journey start time.

If you need an urgent or emergency service, please telephone us.

We will try to help you but can make no guarantee that a driver and vehicle will be available at short notice.

SOME KEY POINTS:

A child, regardless of age, counts as one passenger.
If you need to transport a wheelchair, please specify this at the time of booking.
Your statutory rights are not affected by these terms and conditions.

This document sets out the terms of use for our transportation and related services, the website brightonairportcars.co.uk (“website”), The term “you” “your” or the “Client” refers to any user of our Services such as a passenger, customer, visitor, guest, user, registered user or account holder. By using our Services, you acknowledge and agree to be bound by the following terms and conditions. Your statutory rights are not affected by these terms and conditions.

CONDITIONS OF USE:
It is your responsibility to ensure that the Services made available to you, meet your personal requirements.

Under the provisions of the General Data Protection Regulation (GDPR) it is required you give us permission to contact you. Your permission will be deemed to have been given if you voluntarily provide us with any contact information (telephone number, email address, etc) needed to respond to your enquiry or to confirm or provide your requested Services.
You warrant that any information you provide to us is true, accurate and complete and that provision of such information to us will not breach any other person’s privacy.
It is your responsibility to protect the confidentiality of any username and password you use to access our Services.

When using our Services, you agree to comply with all applicable laws, rules and regulations and you warrant that you will not use our Services for any fraudulent or unlawful purpose. You will refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation.

BOOKINGS:
Bookings must be made at least 48 hours before the required pick-up time.
If you need an urgent or emergency service, please telephone us. We will try to help you but can make no guarantee that a driver and vehicle will be available at short notice.
Your booking will be treated as ‘Booking Request’ until you receive a booking confirmation from us.

WARNING: If you book your transport for the wrong dates, especially pickups and we send a vehicle to collect you, YOU WILL be liable for the full fare for that wasted journey. Please make sure you double check destination leaving dates to the arrival in UK date, some long haul flight are overnight and different dates.

You can change or amend your booking at any time up to twenty-four hours before the journey start time. Just contact us by email, phone. You must allow sufficient time when booking your vehicle to allow for the check-in times required by, for example, your airline. Brighton Airport Cars shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.

You must book a suitable vehicle size for the number of passengers and luggage. We cannot guarantee to carry excessive amounts of luggage over and above what the vehicle is designed for. All luggage is carried entirely at your risk.

If you need to transport a wheelchair, please specify this at the time of booking.
Your driver will travel by the most appropriate route on the day unless instructed otherwise by the Client, in which case additional charges may apply. Unless specified at the time of booking, we may not automatically be able to accommodate additional pick-ups or drop-offs, although every effort will be made to meet such requirements. If our driver is asked to wait either at the beginning or during a journey, we reserve the right to charge waiting time at our current standard rate. (£20.00 per hour or part thereof).

We will endeavor to ensure the vehicle(s) arrive at the time and place requested. We cannot, however, accept responsibility for delays caused by circumstances beyond our control, such as mechanical failure, traffic jams, traffic accidents or extreme weather conditions. Nor do we accept responsibility for any consequential loss.

You agree to treat our drivers and staff, or drivers introduced to you through Brighton Airport Cars with respect and not to cause damage to their vehicles or to engage in any unlawful, threatening, harassing, abusive behavior or activity whilst using their vehicles or any of our Services.

Brighton Airport Cars may in its absolute discretion, without liability and without giving reasons refuse Services to anyone for any reason at any time. We also reserve the right to refuse entry to our vehicles to anyone who is thought to be under the influence of alcohol or drugs and/or whose behavior poses a threat to the safety of the driver, the vehicle or other passengers within the vehicle. We further reserve the right to terminate any journey due to unreasonable or improper behavior or language by any passenger. If special cleaning of any vehicle is required because it has been left in an unreasonable state by a passenger/client, we reserve the right to charge the cost of cleaning to the Client. (£150.00 Maximum Fee).

We reserve the right to substitute any vehicle or driver. If this becomes necessary, without obligation, we will notify you in advance.

AIRPORT PICK UPS:

We work on flight arrival times, not estimated baggage arrivals time. We offer a Meet & Greet service which incurs an extra charge of £10.00 to cover initial car parking fees. We DO NOT enter the terminal until the baggage is in the reclaim area and then we wait at the arranged meeting point which is text to customers after initial contact has been made.

(#) Extra charges can occur if baggage is delayed after showing in reclaim area, if your bag is lost, this extra waiting time is charged at £5.00 per 15 mins or part thereof.

MEETING OUTSIDE TERMINALS:

Our drivers will be at the airports for when you plane lanes. The pickup fee allows you 1 hour from landing to make your way through customs, get your baggage and liaise with your driver via our text message facility. Extra charges will apply if delayed further than the 1 hour. (SEE # ABOVE). If on landing you wish for extra time to get through customs or grab a shower, food etc please state this and reason when booking your journey or we will otherwise use flight arrival time as pickup direction.

CONVEYING OF CHILDREN:
UK law states that taxi or licensed private hire cars are not exempt from legislation relating to children travelling in a baby/child seat. For Health and Safety Reasons Brighton Airport Cars requires all customers to inform us with any children or babies traveling, (Ages).

Please note: that a child, no matter what age, counts as one passenger.
Please check your booking confirmation carefully and inform us promptly of any errors. We shall not be responsible for any delays caused or costs arising from your failure to provide us with correct information.

If you require a child seat for your journey we do have a small selection of seats on a need to use basis, if we don’t have a seat available then it would be the child’s parent/carers responsibility to provide one and to fit the seat in the vehicle and to secure the child. If you are booking a return journey and have your own child seat, the driver who carries out your booking can store your child seat for your return journey? Please remember: to specify the children’s ages in the special requirements section of the booking request so we can supply the correct size seat.

CANCELLATIONS & REFUNDS:
If you need to cancel your booking, please contact us as soon as possible.
You have the right to cancel your booking up to twenty-four hours before journey commencement, without giving any reason. Just notify us in advance by email, phone.
If you have paid in advance, we will refund your payment within 10 days.

If a booking is cancelled within twenty-four hours of the requested pick-up time, we reserve the right to make a nominal charge (Minimum £25.00) for the journey.

Our booking cancellation policy reflects that we will reserve the availability of the vehicle for you and subsequently refuse all other bookings for that vehicle at that time and date of your booked journey.

PAYMENT & CHARGES:
Unless otherwise stated all prices are inclusive of any airport drop off charges.
You agree to make payment in full for any journey you take with us using prepay, cash or card in the vehicle via chip & pin facilities.

Brighton Airport Cars may amend the quotation if there is any material change to the original itinerary, for example the number of passengers or the type or size of vehicle required.
If you do not appear and make contact with our driver at the booked time and the designated pick-up point, we reserve the right to make a full charge for the journey.
We reserve the right to make a full charge and not issue any refunds, if after our vehicle arrives, it transpires the booking was made for the wrong date, wrong time, wrong location and/or other incorrect or misleading information, or if, for any reason whatsoever, the passenger leaves the pickup point without informing us. Pickups will most certainly be charged at FULL PRICE.

Christmas Surcharge: Christmas Eve 24th Dec 00:01am Up to 23:59pm 26th Dec - Normal Fares + 50%

New Year’s Surcharge: New Year’s Eve 31st Dec 00:01am Up to 23:59pm 1st Jan - Normal Fares + 50%
